§ 34-62. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Abandoned property means property having no value other than nominal salvage value, and which has been left abandoned or unprotected from the elements, and includes, but shall not be limited to, wrecked, inoperative or partially dismantled vehicles, including motor vehicles, trailers, boats, machinery, refrigerators, washing machines, appliances, plumbing fixtures, building supplies or materials, furniture and any other similar articles which have no value other than a nominal salvage value.

    Antique motor vehicle means any licensed motor vehicle which is more than 20 years old.

    Board means the City code enforcement board.

    Enclosed area means an area which is completely enclosed by a structure, opaque fence or trees and shrubs meeting the requirements of section 3.07.02 of the land use regulations. If an opaque fence or trees and shrubs are used in lieu of a structure, then the fence or the trees and shrubs shall be at least equal in height to that of the property being housed within the enclosure so that the enclosed property at issue is obscured from ground level sight; and shall be located in the back yard of the residence or premises. If an opaque fence is utilized, the fence must be composed of either solid masonry, wood or chainlink with approved manufactured slats. A garage may qualify as an enclosed area as long as the garage contains a door in working operation and otherwise meets the requirements of this definition. A carport shall not be an enclosed area.

    General agricultural means establishments for the keeping, grazing or feeding of livestock and animals; feedlots; crop lands; aquaculture; silviculture; apiaries; honey extracting; and buildings which are an accessory to such agricultural uses. This category of uses does not include processing or distribution plants for agricultural products and supplies when not an accessory use in conjunction with the agricultural operation.

    Improved lot means any lot which contains a structure for use as a residence, either temporary, permanent or as a business or for business purposes, whether temporary or permanent.

    Inoperative vehicle means a vehicle which is in a state of disrepair or incapable of being moved under its own power, or a vehicle which fails to meet the minimum requirements necessary for lawful operation of a motor vehicle on the streets and highways of the state, including a valid registration or license plate properly attached to the vehicle.

    Junk means any personal property that has only a nominal value or of little significance, including, but not limited to, pieces of old cable or cordage, mats, swabs or oakum, old iron, glass, paper or other waste or secondhand, worn or discarded articles, or other refuse of any nature.

    Lot means any tract or parcel of land which is seven acres or less in size and located within the municipal limits of the City. This term includes the terms "plat," "parcel" and "tract."

    Motor vehicle means an automobile, race car, motorcycle, truck, trailer, semitrailer, truck tractor and semitrailer combination, or any other vehicle operated on the roads of the state, used to transport persons or property, and propelled by power other than muscular power, but shall not include traction engines, road rollers, bicycles or mopeds.

    Nonintensive agriculture means the milking, feeding or sheltering of farm animals, or the growing of supplemental food supplies for the domestic, noncommercial use of the families living on the land.

    Nuisance weeds means and includes, but shall not be limited to, all rank vegetable growth which exhales unpleasant or noxious odors, or which constitutes a possible source of disease or is detrimental to human beings, or such untended vegetable growth that may conceal pools of water, trash or any other deposits which are detrimental to the health, safety and welfare of the public.

    Officer means any code enforcement officer employed or appointed by the City to enforce this Code, state statutes and other rules and regulations.

    Street and highway mean the entire width between the boundary lines of every way publicly maintained, or part thereof, which is open to the public for the purpose of vehicular travel.

    Structure means any object containing a door and supporting walls for each side, which is constructed or installed, and is rigidly and permanently attached to the ground or to another object which is rigidly and permanently attached to the ground.

    Vehicle means every device in, upon or by which any person or property is, or may be, transported or drawn upon a public highway, or upon lands, whether privately- or publicly-owned, or upon rails or guideways, including a bicycle and motorized bicycle. This term shall also include all property included within the term "motor vehicle," as defined in this section.
