§ 6-101. Churches and schools.

  • (a)

    A certificate of zoning approval shall not be issued, and no place of business shall be established within the city, for the sale of malt beverages having an alcoholic content of more than one percent by weight, or wine, regardless of alcoholic content, for consumption on the premises, which place of business is within 300 feet of any established church or school.

    (b)

    A certificate of zoning approval shall not be issued, and no place of business shall be established within the city, for the sale of alcoholic beverages having an alcoholic content of more than one percent by weight, except malt beverages and wine, which place of business is within 750 feet of an established church or school or within 500 feet of any established residence.

    (c)

    The provisions set forth in subsections (a) and (b) of this section shall not apply to the issuance of a certificate of zoning approval for a restaurant providing full meal service seating for at least 75 people at one time, where such restaurant is regulated by the state hotel and restaurant commission; deals primarily in the serving of meals with alcoholic beverage sales only as an incidental service; and is licensed by the division under its special restaurant license provisions.

    (d)

    The following table shall illustrate the required distance separations by the type of license:
